Terms of Service

These Terms of Service ("Terms") govern your use of MobiKhata — the mobile app, the shop web portal, and this website (together, the "Service") — operated by XenifyLabs from Quetta, Pakistan. By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a shop, you are agreeing on that shop's behalf and confirming you have the authority to do so.

1. What MobiKhata Is

MobiKhata is a digital khata and point-of-sale tool for mobile phone shops: tracking inventory, sales, purchases, installment (qist) payments, expenses and customers, with an offline-first mobile app, a web portal for the same shop data, and an admin panel we use to operate the service.

2. Your Account

• You are responsible for the accuracy of the business data you enter and for keeping your password (or Google sign-in) secure.
• A shop owner may invite cashiers and set what each of them can see or do — the owner is responsible for those permissions.
• You must be legally able to enter into these Terms and to operate the business you register.

3. Subscriptions & Payment

• New shops get a free trial period. After it ends, continued use of sync, cloud backup and other subscriber features requires an active paid plan.
• Plans are billed and renewed as agreed when you subscribe (via WhatsApp/manual invoicing, as offered today). We do not store your payment card details.
• If a subscription lapses, your existing records are never deleted or held hostage — they stay on your device and keep uploading, but creating new records and cloud sync of new activity pause until you renew.
• Prices and plans may change; we will not change what you have already paid for retroactively.

4. Your Data

Your shop's inventory, sales and customer records belong to you. We process them to provide the Service as described in our Privacy Policy, and we do not sell them. You are responsible for having the right to store any customer contact details you enter, and for using them lawfully.

5. Acceptable Use

You agree not to: use the Service for anything unlawful; attempt to break its security or access another shop's data; resell or white-label the Service without our written agreement; or upload content that is abusive, fraudulent, or infringes someone else's rights.

6. Service Availability

We aim to keep MobiKhata available and reliable, and the mobile app is built offline-first specifically so a lost connection does not stop your shop from working. That said, the Service is provided "as is" — we do not guarantee it will be uninterrupted or error-free, and we are not liable for losses arising from outages, bugs, or third-party services (payment processors, SMS/WhatsApp, Google Drive backup, etc.) that we depend on but do not control.

7. Termination

You may stop using the Service at any time. We may suspend or terminate an account that violates these Terms, is used fraudulently, or goes unpaid for an extended period after the grace period ends. Where reasonably possible we will give notice first.

8. Limitation of Liability

To the extent permitted by law, XenifyLabs is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost profits or lost data, beyond restoring service and data from our normal backups where applicable.

9. Changes to These Terms

We may update these Terms as the Service evolves. Material changes will be announced in the App or on this page, and the "Last updated" date above will change. Continuing to use the Service after a change means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of Pakistan, and any dispute will be handled in the courts of Quetta, Balochistan, unless local law requires otherwise.
